Terms of Service

These Terms of Service ("Terms") govern your access to and use of Push (the "Service"), a Discord bot that reads your unread Gmail and delivers prioritized briefings to your Discord account. By adding Push to Discord, connecting your Gmail, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required to use Discord in your country, whichever is higher. You must also meet Google's and Discord's own age and account requirements. By using Push, you represent that you meet these requirements and that the information you provide is accurate.

2. What Push does

Push connects to your Gmail account (with your authorization) and reads your unread email in order to generate short, prioritized summaries that are delivered privately to you in Discord. Depending on your plan, Push may also generate draft replies and save them to your Gmail Drafts for your review.

• Push reads your unread mail on a read-only basis for the purpose of summarizing it.
• With Premium, Push may create draft replies in your Gmail. Drafts are never sent automatically — sending always requires your action.
• Summaries and drafts are delivered only to the Discord account associated with your connection.

3. Connecting your Google account

To use Push you authorize it to access your Gmail through Google's OAuth process. You can revoke this access at any time through your Google Account permissions page, after which Push will no longer be able to read your mail. Push's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. 4. Free and Premium plans

Push offers a free tier and a paid Premium subscription. Premium unlocks additional features, including AI-drafted replies. Current pricing is shown on our pricing page and may change from time to time; any change will apply to billing periods beginning after the change takes effect.

5. Billing and subscriptions

Premium is billed as a recurring monthly subscription through our payment processor, Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method on a recurring basis until you cancel.

• Renewal. Subscriptions renew automatically each month unless cancelled before the renewal date.
• Cancellation. You may cancel at any time using the /manage-subscription command, which opens the Stripe customer portal. Cancellation stops future charges; you retain Premium access through the end of the period you have already paid for.
• Refunds. Payments are generally non-refundable except where required by law. Contact ehightowerrojas@gmail.com for refund inquirys.
• Payment data. We do not store your full card details. Payment information is handled by Stripe under its own terms and privacy policy.

6. Referral program

Push may offer a referral program that rewards you and a friend when they subscribe using your referral code.

• A referral reward (such as account credit equivalent to one month of Premium) is granted only after the referred user completes a valid, paid subscription.
• Each user may redeem one referral code, and you cannot redeem your own code.
• Rewards have no cash value, cannot be transferred or sold, and are applied as credit toward future invoices.
• We may modify, suspend, or end the referral program, and may withhold rewards we reasonably believe result from fraud, abuse, or violation of these Terms.

7. Acceptable use

You agree not to:

• Use the Service in violation of any law, or of Discord's or Google's terms.
• Attempt to access accounts, data, or systems that are not your own.
• Interfere with, overload, or disrupt the Service or its infrastructure.
• Reverse engineer, scrape, or attempt to extract source code except as permitted by law.
• Abuse the referral program or attempt to obtain rewards through fraudulent means.

We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful to other users, us, or third parties.

8. AI-generated content

Premium uses automated systems to generate summaries and draft replies. This content may contain errors, omissions, or inaccuracies. You are responsible for reviewing any summary or draft before relying on it or sending it. Push does not send any reply on your behalf without your action, and we are not responsible for the content of messages you choose to send.

9. Third-party services

Push depends on third-party services including Discord, Google/Gmail, and Stripe. Your use of those services is governed by their own terms and policies. We are not responsible for the availability, accuracy, or actions of third-party services, and interruptions in those services may affect Push.

10. Availability and changes

We provide the Service on an "as available" basis and may modify, suspend, or discontinue any part of it at any time. We may also update these Terms; when we do, we will revise the "Last updated" date above, and material changes will be communicated where reasonable. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT SUMMARIES OR DRAFTS WILL BE ACCURATE OR COMPLETE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may stop using Push at any time by removing the bot, revoking its Google access, and (if subscribed) cancelling your subscription. We may suspend or terminate your access if you violate these Terms. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will survive.

15. Governing law

These Terms are governed by the laws of California, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the courts located in California, unless otherwise required by applicable law.
